Procter & Gamble Misrepresents the Health Benefits of Align
Customers sued Procter & Gamble, the company that makes and sells Align. The customers claim that Align – a probiotic supplement – is deceptively advertised. Align claims to provide digestive health benefits that it does not actually provide. The customers contend that Align is like snake oil – a product that does not do what it promises. The trial court certified a class of Align purchasers in five states: California, Florida, Illinois, New Hampshire and North Carolina. To read the trial court’s order granting class certification, click here.
Procter & Gamble appealed. The court of appeal agreed with the trial court and the plaintiffs and denied the appeal. To read the court of appeal order, click here.
Trial is scheduled to begin in October 2017.
